Terms and Conditions

These commercial terms govern subscriptions, paid platform services, billing, and transactions made through Proficient Homes.

1. Operator and scope

Proficient Homes is a property and home-management technology platform operated by Proficient Property Services ("PPS," "we," "us," or "our"). These Terms and Conditions apply to purchases, subscriptions, and paid services offered through Proficient Homes. They supplement the Terms of Use, Privacy Policy, Return and Refund Policy, User Agreement, and any separate lease, property-management agreement, maintenance authorization, vendor agreement, estimate, work order, or other written contract.

If a separate signed agreement conflicts with these Terms and Conditions on a matter specifically covered by that agreement, the signed agreement controls for that matter.

2. Eligibility and authority

You must be at least 18 years old and legally able to enter into a contract to purchase a subscription or paid service. If you act for an owner, property manager, resident household, vendor, company, or other organization, you represent that you have authority to bind or act for that party to the extent required for the transaction.

3. Subscriptions and recurring billing

  • Subscription pricing, included features, billing period, and any trial or promotional terms will be shown before purchase.
  • By starting a recurring subscription, you authorize the applicable payment method to be charged at each renewal until cancellation.
  • You may cancel a subscription to stop future renewals. Unless required by law or stated otherwise at checkout, cancellation does not create a prorated refund for the current billing period.
  • We may change prices or plan features prospectively. When required, we will provide notice before the change applies to a renewal.

4. Property-related payments are separate

Rent, security deposits, application or leasing charges, maintenance charges, owner-funded repairs, vendor invoices, reimbursements, and other property-specific transactions are not ordinary purchases of the Proficient Homes software. Their amount, due date, refundability, allocation, and legal treatment are controlled by the applicable lease, service agreement, estimate, work order, property-management agreement, vendor agreement, and applicable law.

Proficient Homes may provide technology to initiate, document, route, or display these transactions, but the platform does not change the parties' underlying contractual or statutory rights.

5. Payment processing

Payments may be processed by third-party payment providers. Payment card or bank details may be submitted directly to those providers and are subject to their terms and privacy practices. We may receive transaction identifiers, payment status, limited billing details, and other information needed to reconcile transactions and provide receipts or account records.

6. Taxes, fees, and failed payments

You are responsible for charges, taxes, and authorized fees disclosed for your transaction. If a payment fails, is reversed, or is disputed, access to paid features may be limited and any underlying amount due under a lease or service agreement remains subject to that agreement and applicable law.

7. Electronic records and signatures

You consent to receive transaction records, notices, receipts, and agreements electronically when the platform offers electronic delivery. Where an electronic-signature feature is used, you agree that an electronic signature or affirmative acceptance may have the same legal effect as a handwritten signature to the extent permitted by law.

8. Service availability and changes

We may update, improve, suspend, or discontinue features. We do not guarantee uninterrupted availability. Planned maintenance, security events, internet failures, third-party outages, and circumstances outside our reasonable control may affect service.

9. Disclaimers and limitation of liability

Proficient Homes is a technology and workflow platform. It is not a law firm, accounting firm, insurer, emergency service, home inspector, licensed contractor, or substitute for professional legal, tax, safety, construction, or property-specific advice. Information, reminders, templates, automation, and suggested maintenance tasks are general operational tools and should be reviewed for the specific property and jurisdiction.

To the maximum extent permitted by law, the platform is provided on an "as available" basis and PPS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the platform. Nothing in these terms limits liability that cannot legally be limited.

10. Governing law and changes

These Terms and Conditions are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules, except where another law must apply. We may update these terms prospectively. Material changes will be communicated through the service or another reasonable method.
